Terms of Service

These terms govern your use of polarshots.com and our photography services. By placing an order (including the free trial) you accept them.

1. The service

PolarShots produces AI-generated on-model product imagery from photographs you supply. Model figures in delivered images are synthetic (AI-generated); they are not photographs of real people. Delivered imagery is labelled/disclosed in line with ASCI guidance on AI-generated content, and you are responsible for retaining such disclosures where the platform you publish on requires them.

2. Our quality promise — and its honest limit

Every delivered image is checked against your garment's photographs, region by region, before delivery, and deliveries include zoom comparisons so you can inspect the work. Our fidelity promise covers the garment's design: motifs, colours, placement, structure. At extreme magnification, fabric texture is re-rendered rather than photographed; we show you exactly how close it comes and you judge before paying. We do not promise stitch-for-stitch pixel identity, and no AI service honestly can.

3. Free trial

Your first piece is produced free of charge. If the images don't meet your bar, you owe nothing and may keep the comparison images. The free trial is one piece per business, and we may decline pieces outside our current scope (we'll say so upfront).

4. Quotes, payment and delivery

• Pricing is per piece, quoted over WhatsApp before work begins. A quote accepted in writing (including WhatsApp message) forms the order.
• Standard delivery target is 48 hours from our confirmation that your input photos are usable. This is a service target, not a guaranteed term; §9 applies.
• Payment terms (advance/on-delivery) are stated with the quote. Delivered images may be watermarked until payment completes.

5. Revisions and acceptance

Each delivered piece includes one round of revision for deviations from the agreed brief or from the garment's design. You must raise revision requests within 7 days of delivery; after that, or on first commercial use of an image, the delivery is deemed accepted. Preference changes beyond the brief (new scene, new pose set) are quoted as new work.

6. Your inputs — what you promise us

You warrant that: (a) you own or are licensed to use the photographs you send us and the products they depict; (b) your instructions don't ask us to copy another brand's protected work (including counterfeit goods); (c) your photos contain no third parties' personal data you're not entitled to share. You indemnify us against claims arising from a breach of these warranties. We may refuse inputs that appear to violate them (e.g., watermarked images from other sellers).

7. Rights in the deliverables

On full payment you receive a perpetual, worldwide, transferable licence for unrestricted commercial use of your delivered images (marketplaces, social, advertising, print). We retain the underlying generation know-how, templates and synthetic model identities. We may show your originals or delivered images in our public portfolio only with your written consent — asked per client, never assumed.

8. Synthetic models

Synthetic model identities may appear across multiple clients' imagery unless you commission an exclusive identity (quoted separately). Synthetic models do not depict real persons; any resemblance is coincidental.

9. Liability

Our total liability for any order is capped at the fees paid for that order (for the free trial: ₹0 — your remedy is that you don't pay and don't use the images). We are not liable for indirect losses (lost profits, platform policy actions, returns/chargebacks on your sales). Nothing in these terms limits liability that cannot be limited under Indian law.

10. Platform compliance

You are responsible for compliance with the listing/imagery policies of the platforms where you publish (Myntra, Amazon, Flipkart, Meta, etc.), including their AI-imagery and disclosure rules. We'll flag what we know, but their policies are yours to meet.

11. Termination and misuse

We may decline or discontinue service for unlawful use, counterfeit goods, abusive conduct, or non-payment. You may stop using the service at any time; accepted orders remain payable.

12. General

These terms are governed by the laws of India; courts at Delhi have exclusive jurisdiction. If a clause is held unenforceable, the rest survive. We may update these terms; continued orders after an update constitute acceptance. Questions: hello@polarshots.com.
